You can get multiple C&D letters for the same file, and an ISP will typically either issue a warning after getting a letter, or they'll terminate the account after so many notices for the same account (i think the avg is 5). Lawsuits usually come from a random sample with no previous C&D letters sent, and those are typically for ppl that host for longer than they took to d/l.
